GIFT CARD TERMS OF USE
1.1. The present Terms and Conditions of the Gift Card (hereinafter the “Terms and Conditions”) govern the purchase, use and redemption of Gift Cards issued by the company SARKK S.A., having its headquarters at 67 Tzavella str., Halandri, Attica, T.I.N. 094526950 and G.E.MI. No. 124189401000 (hereinafter the “Company”).
1.2. Electronic Gift Card is purchased exclusively through the Company’s e-shop calvinklein.cy.
1.3. Unless explicitly defined otherwise in the present Terms and Conditions, the Electronic Gift Card:
1.4. For the purposes of the present Terms and Conditions:
2.1. The Electronic Gift Card purchased through the e-shop calvinklein.cy is sent exclusively to the recipient through electronic mail (e-mail), at the e-mail address the purchaser gives during the completion of the purchase.
2.2. The Electronic Gift Card is purchased exclusively using the payment methods available on the online store at the time of checkout. Payment on delivery, payment in installments (including Klarna service or any other “Buy Now – Pay Later (BNPL)” service) or any other method of deferred payment is not allowed. The purchase of the Electronic Gift Card may not be combined with the simultaneous purchase of other products.
2.3. For the purchase of the Gift Card no other Gift Card, Credit Voucher, voucher, promotional discount voucher or similar benefit can be used, unless this is explicitly allowed by the Company.
2.4. The Gift Card is activated and becomes valid only after the successful completion of a purchase and its activation in the Company’s information systems.
2.5. In case the Electronic Gift Card is purchased in favor of a third person, the purchaser is responsible for the accuracy of the recipient’s data and must have informed and received the consent of, where required, the recipient regarding the process of the personal data, pursuant to the Company’s Privacy Policy.
2.6. The Company processes the personal data related to the purchase and delivery of the Electronic Gift Card pursuant to applicable legislation on the personal data protection and the Company’s Privacy Policy.
2.7. The Company is not liable for the non-delivery or delayed delivery of the Electronic Gift Card due to circumstances out of its reasonable control, indicatively including the following cases:
3.1. The Electronic Gift Card may be used exclusively for the purchase of products available from the Company through the e-shop calvinklein.cy, and may not be used in physical stores.
3.2. The Electronic Gift Card:
3.3. If the value of the purchase exceeds the value of the Gift Card, the customer must pay the amount of the discrepancy using any other payment method acceptable in checkout.
3.4. If the value of the purchase is smaller than the value of the Gift Card, the transaction cannot be completed. The partial redemption of the Gift Card is not allowed.
3.5. The Gift Card is not exchanged for money, not transferred to a bank account and not redeemed for its monetary value unless this is explicitly required by the applicable legislation.
3.6. The Electronic Gift Card is not personal and can be used by any person who holds and brings it for use. The Company is not obliged to verify the identity of its holder.
3.7 The redemption of the Gift Card in the electronic shop is made by entering its number in the field “Gift Card / Credit Voucher” during the completion of the order. The combination of the Electronic Gift Card and credit vouchers is not possible at the same order.
4.1. The Gift Card is valid for a period of six (6) months from the date it is issued. The date the Gift Card is activated in the Company’s information systems pursuant to clause 2.4 is considered to be the date of issue.
4.2. Once its valid period is over, the Electronic Gift Card can no longer be used for the purchase of products and any unused amount shall automatically cease to apply.
4.3. The duration of validity of the Electronic Gift Card cannot be extended, renewed or reactivated unless it is explicitly provided for in the present Terms and Conditions or required by the applicable legislation.
5.1. The holder of the Electronic Gift Card is exclusively responsible to keep and use it.
5.2. The Company is not responsible for the loss, theft, damage, and unauthorized use or disclosure of the Gift Card or its code after it has been issued or delivered to the purchaser or recipient unless the damage is due to fraud or gross negligence of the Company or it is otherwise imposed by the applicable legislation.
5.3. Lost, stolen, deleted or used without authorization Gift Cards are not replaced, returned or reissued.
5.4. The Company reserves the right to refuse the acceptance of a Gift Card when there are reasonable indications that it has been obtained, altered, counterfeited, copied or fraudulently used or used in breach of the present Terms and Conditions.
6.1. The return of products purchased by totally or partially using the Gift Card is governed by the current Returns Policy of the Company and the present Terms and Conditions.
6.2. None of the provisions of the present Terms and Conditions shall limit or affect the rights granted to the customers by the applicable legislation regarding the consumers’ protection, including rights related to non-compliant, defective or incorrectly delivered products as well as any other right of withdrawal, replacement, repair, reduction of the consideration or withdrawal from the contract provided for in the applicable legislation.
7.1. For products purchased through the electronic shop calvinklein.cy using the Gift Card, the consumer may exercise the legal right of withdrawal within the deadline and under the conditions provided for in the applicable legislation and the Company’s Returns Policy.
7.2. If the purchase is paid partially using the Gift Card and partially using another payment method, the amount paid using another payment method is refunded through the same payment method used during the initial purchase, up to the amount paid using it pursuant to the applicable legislation.
7.3. In case of a full return of products purchased through the electronic shop, the customer receives a Credit Voucher for an amount equal to the amount initially paid using with the Gift Card. Any additional amount paid using another payment method is refunded through the same payment method used during the initial purchase pursuant to the applicable legislation.
7.4. In case of a partial return of products purchased through the electronic shop, the customer receives a Credit Voucher for an amount equal to the part of the consideration corresponding to the returned product and that was initially paid using the Gift Card. Any additional amount paid using another payment method is refunded through the same payment method used during the initial purchase, up to the amount paid using this payment method.
7.5. In case the electronic order is cancelled before it is completed, or the customer refuses to receive the order or the order is returned to the Company as non-delivered, the initial Gift Card is reactivated for the amount used during the purchase. The reactivated Gift Card reserves its initial expiry date.
8.1. Any Gift Card or Credit Voucher obtained, altered, counterfeited, copied or used in contrary to the present Terms and Conditions is deemed invalid and the Company may refuse to accept it.
8.2. The Company reserves the right to inactivate, suspend or refuse to accept any Gift Card, Credit Voucher or Store Credit Voucher, when there are reasonable indications that it has been obtained or used in a fraudulent way or in breach of the present Terms and Conditions.
9.1. The exercise of the legal right to withdraw from the purchase of the Electronic Gift Card is accepted, on the condition that it has not been redeemed, pursuant to the following terms:
10.1. The Company reserves the right to amend the present Terms and Conditions at any time, to the extent allowed by the applicable legislation.
10.2. Any amendment of the present Terms and Conditions is posted at the Company’s official website, calvinklein.cy, and will be effective from the date it is posted unless otherwise defined.
11.1. The personal data collected or processed in the context of the purchase, delivery or use of the Gift Card is processed pursuant to the current Privacy Policy of the Company, which is available at the Company’s official website www.sarkk.org.
12.1. The purchase, delivery and/or use of the Gift Card entails the full and unreserved acceptance of the present Terms and Conditions as well.
